All users of this site agree that access to and use of this site are subject to the following terms of service and other applicable law. If you do not agree with these terms, please do not use this site. By purchasing services or products from this website, you, confirm that you read, understood, and agreed with the following terms of service.

What are the session fee and coverage fees?

The session fee and coverage fees are due upon booking our services and secure a date on our calendar, including our time and talent. We will do our best to accommodate your preferred date, or schedule a new date if yours is not available. The session and coverage fees do NOT include any digital photo/video downloads or physical products. All products including digital photo/video downloads must be purchased separately, please view our price list. The session and coverage fees are NON-REFUNDABLE, however, they can be used towards a future portrait session within 6 months or wedding coverage within 12 months, in case you need to cancel or reschedule. 48 hours notice (for portrait sessions) and 2 weeks notice (for weddings) of postponements or cancellations is appreciated. 

Do you offer session or coverage fee refunds?

Refunds are not available. The client agrees that the session and coverage fees fairly compensate Everis Photo & Video for committing to provide the services to the client and turning down other potential clients. If it becomes impossible for us to provide our services due to the fault of the client (or parties related to the client), including the need of changing the service date, Everis Photo & Video will not be obligated to refund any monies (fees) the client has previously paid.

What happens if I’m late for my session?

We will not be responsible if you, and/or key individuals fail to appear or cooperate during your session. If you’re late, your session will be cut short.

Who will perform artistic judgment on your services?

By purchasing our services from this website, you confirm that: you have spent a satisfactory amount of time reviewing our work and have a reasonable expectation that we will perform the services in a similar manner and style; we will use reasonable efforts to ensure your suggestions are produced in a style and manner consistent with our current portfolio, however, you understand and agree that: every client is different, with different tastes, budgets, and needs; photography and videography are often subjective arts and we have an unique vision, with an ever-evolving style and technique; we will use our artistic judgment when providing you our services, which may not include strict adherence to your suggestions; although we will use reasonable efforts to incorporate your suggestions and desires when providing you services, we shall have the final say regarding the aesthetic judgment and artistic quality of our work; dissatisfaction with our aesthetic judgment or artistic ability are not valid reasons to request of any monies returned.

Do you require to be the exclusive service providers?

The client understands and agrees that he or she has hired Everis Photo & Video exclusive of any other service provider. In order to provide a high level of satisfaction and quality of service, no other service providers, other than an assistant or third party that we hire to complete the services are permitted to provide the same or similar services, at the location and date requested by the client.

How will you handle difficult working conditions?

The client expressly agrees to take the best efforts to provide us and our team members with safe and appropriate working conditions. In the event of circumstances deemed by either us or a bystander to present a threat or implied a threat of injury or harm to our staff or equipment, Everis Photo & Video reserves the right to cancel all services remaining and leave the event. At our discretion, after the first offense, we will make reasonable efforts to notify the client or a responsible party. If the client is able to respond to the threatening situation in a reasonable amount of time, we shall resume work. If the threatening behavior occurs for a second time, the client will agree to remove the offending person for the remainder of the event. If the behavior occurs a third time, we will immediately leave the event. If we leave the event early due to any offending behavior, the client expressly agrees to relieve and hold us harmless as a result of incomplete event coverage, or for a lapse in the quality of our work.

How are the files managed?

The Photographers and Videographers at Everis Photo & Video will be the ones choosing which of the photographs and video clips from your session or event are edited and viewed. All the final files are copyrighted to and remain the property of Everis Photo & Video, and we reserve the right to use them for an online portfolio, print, or advertising. The Client assigns Everis Photo & Video the irrevocable and unrestricted right to use and publish your photos and videos in which you and any other individuals may be included, releasing all claim to profits that may arise from such use. Everis Photo & Video will decide which images are edited and viewed. The re-editing of any images is strictly prohibited. This includes adding filters. Only cropping for printing is allowed. The Client is obtaining photos and videos for personal use only, and shall not sell said photos or videos or authorize any reproductions.

What state governs these laws?

The laws of Massachusetts govern all matters arising out of or relating to these terms and conditions. If any portion of terms and conditions is deemed to be illegal or unenforceable, the remaining provisions of this page will remain in full force.
